Terms of Service

1. Agreement to Terms

By accessing or using the WikiDuck service, you agree to be bound by these Terms of Service ("Terms") and by our Privacy Policy. These Terms apply to all visitors, users, and others who wish to access or use the Service. If you disagree with any part of the terms then you do not have permission to access the Service.

2. User Accounts

When you create an account with us, you guarantee that you are above the age of 18 or a parent or guardian helps you create an account.

  • You are responsible for maintaining the confidentiality of your account and password.
  • You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
  • You must not use as a username the name of another person or entity or that is otherwise offensive, vulgar, or obscene.

3. Content Ownership

You retain all of your rights to any content you submit, post, or display on or through the Service, including text, files, images, photos, video, sounds, music, and other materials ("User Content").

  • By posting User Content, you grant WikiDuck a non-exclusive, worldwide, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content on and through the Service.
  • You are responsible for the legality, reliability, and appropriateness of all User Content you submit.
  • We reserve the right to remove any content that we deem harmful, illegal, or in violation of these Terms.

4. Prohibited Uses

You may use the Service only for lawful purposes and in accordance with the Terms. You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
  • To post custom, third-party advertisements, monetize through sponsorships, or implement membership programs if you are on the Free plan. WikiDuck reserves the exclusive right to place advertisements on Free plan wikis. Full advertising and monetization control is available on Pro plan and above. You are permitted to use a dedicated donation page or button on all plans.
  • To obscure, cover, or intentionally impair the functionality of any elements of the Service, including mandatory links or attribution (such as the WikiDuck footer).
  • To impersonate or attempt to impersonate WikiDuck, a WikiDuck employee, another user, or any other person or entity.

5. Fees and Payments

Certain aspects of the Service are billed on a subscription basis (the "Subscription"). You will be billed in advance on a recurring and periodic basis (such as monthly or annually), depending on the Subscription plan you select. You acknowledge that your Subscription will automatically renew unless you cancel it or WikiDuck terminates it.

6. Limitation of Liability

In no event shall WikiDuck, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.

Copyright Policy

1. Overview of Policy

WikiDuck respects the intellectual property rights of others and expects its users to do the same. This policy outlines our procedures for handling copyright infringement claims relating to content hosted on our Service.

2. Intellectual Property Rights

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of WikiDuck and its licensors. The Service is protected by copyright and other applicable intellectual property laws of both the United States and foreign countries. The trademarks, service marks, and trade dress associated with WikiDuck are proprietary property and may not be used in connection with any product or service without the prior written consent of WikiDuck.

3. User Responsibility

You are solely responsible for ensuring that all content you post on your wiki, including text, images, and other media, does not violate the copyright or other intellectual property rights of any third party.

  • By posting content, you affirm that you own the content or have the necessary rights and permissions to use it and grant the required license to WikiDuck as outlined in the Terms of Service.
  • Any content found to be infringing may be removed immediately without prior notice.

4. Reporting Infringement

If you believe that any content on the Service infringes upon your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  • An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
  • A description of the copyrighted work that you claim has been infringed, including the URL where the material is located.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
